1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Eureka and Eureka Engine, which are separate FreeGym products (together, the "Products", and individually, a "Product"). In these Terms, "we", "us", and "our" mean FreeGym, the entity that operates the Products. "FreeGym Parties" means FreeGym and FreeGym's founders, directors, officers, employees, contractors, contributors, affiliates, agents, service providers, and licensors. The Products include their websites, waitlists, early-access programs, AI conversations, memory, reports, reminders, documents, and related services.
By visiting a Product website, joining a waitlist, creating or using a FreeGym account for access to either Product, using either Product, uploading information, or otherwise accessing the Products, you agree to these Terms and to the Eureka and Eureka Engine Privacy Policy.
Your agreement is with FreeGym. Eureka and Eureka Engine are product names and are not separate contracting entities unless a later written agreement says otherwise. No founder, director, officer, employee, contractor, contributor, service provider, or licensor is personally entering into these Terms with you.
If you do not agree, do not use the Products.
The Products use the same login and sign-up system as FreeGym. The FreeGym terms and policies also apply to your FreeGym account, profile, community activity, public posts, direct messages, and other FreeGym platform features.
2. Eligibility
You may use the Products only if:
- you can enter into a binding agreement;
- you are not prohibited from using the Products under applicable law;
- you provide accurate and current information;
- you use the Products only for lawful purposes; and
- you follow these Terms.
You must be at least 18 years old to create or use a FreeGym account for access to either Product or join paid Product services on your own. If you are under 18, a parent or legal guardian must consent to your use, accept these Terms on your behalf, and supervise your use.
The Products are not directed to children under 13.
3. What the Products Are
Eureka and Eureka Engine are separate personal AI health-coaching products with continuity. They are designed to help you organize, understand, and act on health and fitness information in daily life. Their outputs and safety behavior are AI-generated, probabilistic, and non-deterministic, which means similar inputs may produce different outputs and errors may occur.
The Products may help with the following intended functions, though none of them are guaranteed to work correctly in every case:
- training, sport-specific programming, exercise decisions, mobility, and recovery;
- nutrition planning, food decisions, hydration, supplements, and habit-building;
- sleep, energy, stress, routines, and behavior change;
- pain, movement limitations, rehab context, and training adjustments;
- women's health context, including cycle, pregnancy, postpartum, perimenopause, and menopause-related organization and coaching support;
- family health responsibilities, such as tracking appointments, medication notes, reports, care routines, and questions for doctors;
- lab reports, wearable exports, prescriptions, screenshots, PDFs, and other documents you provide;
- summaries, checklists, plans, doctor-visit notes, and other useful artifacts;
- reminders, follow-ups, and open loops; and
- attempting to help you identify when a question belongs with a licensed professional instead of an AI coach.
The Products are built to reason carefully, but they are still software. They can be wrong, incomplete, inconsistent, delayed, or inappropriate for your situation, including in health-safety situations.
4. What the Products Are Not
Neither Product is:
- a doctor;
- a hospital or clinic;
- an emergency service;
- a therapist or crisis hotline;
- a diagnostic system;
- a prescription service;
- a medical device unless separately classified as such in the future;
- a substitute for professional medical advice, diagnosis, or treatment;
- a substitute for medical clearance before exercise, diet changes, supplement use, medication changes, pregnancy-related decisions, or management of a health condition; or
- a replacement for a qualified physician, mental health professional, physiotherapist, dietitian, or other licensed professional.
The Products do not diagnose, treat, cure, or prescribe. The Products may help organize information and prepare questions for your clinician, but your clinician remains responsible for medical diagnosis and treatment.
Never delay emergency care or professional medical care because of something either Product says or fails to say.
5. Emergency and High-Risk Situations
Do not use the Products for emergencies.
Seek immediate medical attention or contact your local emergency number if you experience or are concerned about:
- chest pain, pressure, fainting, severe shortness of breath, or signs of heart attack;
- stroke-like symptoms, severe headache, sudden weakness, confusion, seizure, or loss of consciousness;
- severe allergic reaction, swelling of the face or throat, or breathing difficulty;
- suicidal thoughts, self-harm risk, psychosis, severe panic, or a mental health crisis;
- severe or rapidly worsening pain;
- suspected fracture, major trauma, deep wound, or uncontrolled bleeding;
- pregnancy bleeding, severe abdominal pain, reduced fetal movement, severe headache, visual symptoms, or other urgent pregnancy concerns;
- extremely high blood pressure or symptoms with high blood pressure;
- medication overdose, dangerous drug interaction, or poisoning;
- signs of infection, sepsis, or serious deterioration; or
- any situation where a reasonable person would seek urgent medical care.
If either Product tells you to contact a doctor or emergency service, you agree to treat that as a safety boundary, not as optional product text.
6. AI Limitations
The Products use AI systems that generate outputs based on your inputs, stored context, retrieval systems, automated safety checks, and model behavior. AI is a non-deterministic technology. It is expected to be imperfect, and it must be used responsibly as a tool to make life easier, not as something to rely on blindly. AI outputs and safety checks are probabilistic and may vary between similar prompts. They may:
- contain factual errors;
- misunderstand your context;
- miss important risks;
- overstate or understate evidence;
- fail to identify a medical emergency;
- answer outside the Products' intended coaching scope, especially if you repeatedly prompt, rephrase, or pressure the system;
- misread a document or image;
- produce outdated information;
- give guidance that does not fit your body, condition, medication, pregnancy status, or constraints;
- sound more confident than warranted; or
- fail to enforce a stated safety boundary consistently.
You are responsible for reviewing Product output before relying on it. If either Product gives an answer outside its intended scope, appears to bypass a safety boundary, or responds after repeated prompting, that answer is still not medical advice, medical clearance, diagnosis, treatment, prescription, or authorization to ignore professional care. For medical, legal, financial, safety-critical, or high-impact decisions, consult a qualified professional.
7. Your Responsibilities
You agree to:
- provide accurate, complete, and current information;
- update the relevant Product when your health status, symptoms, medications, supplements, pregnancy status, injuries, or constraints change;
- treat the Products as tools for support, organization, and decision preparation, not as a replacement for your own judgment;
- review outputs carefully and avoid relying blindly on any AI response, memory, reminder, summary, recommendation, or safety check;
- use judgment before acting on any AI output;
- consult a qualified professional before beginning or changing exercise, nutrition, supplement, medication, rehab, pregnancy, or treatment decisions;
- never stop, start, or change prescribed medication based solely on either Product;
- stop any exercise or protocol that causes unusual pain, concerning symptoms, or deterioration;
- seek medical clearance when appropriate;
- protect your account credentials;
- use the Products only for lawful and appropriate purposes;
- respect other people's privacy; and
- comply with these Terms and applicable law.
You are responsible for your own health decisions and for the information you choose to submit.
8. Information About Other People
The Products can help organize family health responsibilities, but you may submit information about another person only if you have permission or legal authority to do so.
By submitting information about another person, you confirm that:
- you have their consent or legal authority;
- you will not upload information obtained unlawfully or in breach of a professional, employment, confidentiality, or fiduciary duty;
- if the person is a minor, you are the parent or legal guardian or have appropriate guardian consent;
- you will not use the Products to make unauthorized medical decisions for someone else; and
- you will remove or correct information if consent is withdrawn or if you learn that the information should not have been shared.
We may remove, restrict, or delete third-party information if we believe it was submitted without proper authority.
9. Accounts and Access
Some Product features may require a FreeGym account, invitation, cohort acceptance, or paid plan. The Products do not use a separate login or sign-up system from FreeGym.
You are responsible for:
- keeping your login credentials secure;
- all activity under your account;
- notifying us promptly of unauthorized access;
- maintaining compatible devices and internet access; and
- ensuring that the information in your account is accurate.
We may refuse, suspend, limit, or terminate access if we believe there is abuse, security risk, legal risk, violation of these Terms, or unsafe use.
10. Waitlist and Early Access
Joining the waitlist does not guarantee access, timing, pricing, availability, feature set, or eligibility.
The Products may open in small cohorts. We may choose participants based on product needs, safety, geography, language, use case, capacity, or other criteria.
Early-access versions may be incomplete, experimental, unstable, and subject to change. Features may be added, removed, limited, paused, or modified at any time.
If you provide feedback, suggestions, bug reports, product ideas, or other submissions, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them to improve the Products and related FreeGym products without compensation to you. This does not give us ownership of your private health data.
11. Paid Services, Billing, and Refunds
The public product websites and waitlists are currently free, and no payment processor is currently connected to the public product websites. The Products may later offer paid subscriptions, paid early access, paid coaching support, paid reports, or other paid services.
If paid services are introduced and you purchase one:
- fees, billing period, renewal terms, cancellation terms, refund terms, taxes, and included features will be shown at checkout or in an order document;
- if checkout is introduced, you authorize the disclosed payment processor to charge the selected payment method under the purchase terms;
- you are responsible for applicable taxes unless stated otherwise;
- failed payments may lead to suspension or termination of paid access;
- cancellation stops future renewals but does not automatically refund past charges unless required by law or stated in the purchase terms; and
- any payment processor used for paid services will be disclosed at checkout or in the applicable purchase terms, and may apply its own terms and privacy policy.
If specific purchase terms conflict with these Terms, the purchase terms control only for that paid service.
12. User Content and Your Data
"User Content" means information, messages, voice/audio recordings and transcripts, files, images, PDFs, reports, prompts, feedback, and other material you submit to either Product.
You retain ownership of your User Content. You grant us a limited license to host, store, copy, process, transmit, display, transform, summarize, analyze, and use your User Content as needed to:
- provide the Products;
- maintain memory and continuity;
- generate outputs and artifacts;
- provide support;
- improve reliability and safety;
- comply with law;
- enforce these Terms; and
- exercise the rights described in the Privacy Policy.
This license ends when your content is deleted from active systems, subject to backups, legal obligations, security records, dispute preservation, and de-identified or aggregated data.
You are responsible for ensuring you have the rights needed to submit User Content.
13. Product Outputs
Subject to your compliance with these Terms, you may use Product outputs for your personal, family, or internal purposes. You may share outputs with your doctor, coach, family member, or caregiver if you choose.
You are responsible for reviewing outputs before using or sharing them. Outputs may not be unique. Other users may receive similar or identical outputs.
You may not represent Product outputs as professional medical advice, clinical diagnosis, or a substitute for care from a licensed professional.
14. Intellectual Property
FreeGym and its licensors own Eureka, Eureka Engine, the product websites, software, workflows, interface, brand, logos, product design, AI orchestration, prompts, evaluation methods, safety systems, documentation, and other proprietary materials.
You may not:
- copy, modify, distribute, sell, lease, sublicense, or exploit either Product or its content except as permitted by these Terms;
- reverse engineer, decompile, or attempt to extract source code, prompts, model logic, embeddings, system instructions, or safety mechanisms;
- scrape, crawl, harvest, or bulk export the Products without permission;
- use either Product to build a competing product or dataset;
- remove proprietary notices;
- misuse the FreeGym, Eureka, Eureka Engine, 10X Longevity, or FreeGym-Wiki names or branding; or
- claim ownership of our product, research layer, or proprietary systems.
FreeGym-Wiki and other public resources may have their own licenses and terms. Those terms apply to those resources.
15. Acceptable Use
You agree not to use the Products to:
- violate law or another person's rights;
- upload data you do not have authority to share;
- generate medical instructions for others without appropriate qualifications and consent;
- provide or automate professional medical services without proper licensing and oversight;
- make emergency, diagnostic, treatment, prescription, insurance, employment, legal, financial, or other high-impact decisions without qualified human review;
- create, request, or spread harmful health misinformation;
- encourage self-harm, eating disorders, dangerous supplement use, unsafe training, or medication misuse;
- harass, threaten, exploit, shame, or abuse anyone;
- upload malware, phishing links, or harmful code;
- attempt unauthorized access to systems or data;
- interfere with service security, rate limits, or integrity;
- run automated scraping, benchmarking, or model extraction without permission;
- misrepresent Product output as human-authored professional advice;
- use prompts, rephrasing, roleplay, or pressure to bypass Product safety boundaries or obtain medical, emergency, prescription, or other out-of-scope guidance; or
- use either Product in any way that we reasonably believe creates safety, legal, privacy, or reputational risk.
We may suspend or terminate access for violations.
16. Third-Party Services
The Products may rely on or link to third-party services, including cloud hosting, authentication, database and file storage, security, AI model processing, analytics and reliability, notification delivery, weather/display features, content delivery, payment processors if paid features are introduced, FreeGym, FreeGym-Wiki, GitHub, Google Fonts, and other services.
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.
When you choose to send Product outputs or reports to a doctor, coach, family member, or other third party, you are responsible for that sharing. The Products do not route conversations, outputs, or reports to doctors, hospitals, emergency services, medical authorities, or other third parties.
17. Privacy
Our Privacy Policy explains how we collect, use, retain, and share information. By using either Product, you agree to the Privacy Policy.
You should not submit unrelated secrets, credentials, government ID numbers, financial account credentials, or other highly sensitive information unless a feature specifically requests it and you are comfortable with the risks.
18. Confidentiality and Public Sharing
Private Product conversations and uploaded files are treated as private according to the Privacy Policy.
If you choose to publish a conversation, share a link, post an output, use a public FreeGym feature, provide a testimonial, or approve a case study, the shared material may become visible to the audience you selected or to the public.
We will not use your private conversations, health files, name, likeness, or identifiable story for marketing without your explicit consent.
19. No Guarantees
The Products are provided to help with organization, coaching support, and decision preparation. We do not guarantee:
- medical accuracy;
- clinical outcomes;
- fitness results;
- weight loss, strength gain, pain relief, improved labs, recovery, or behavior change;
- uninterrupted or error-free service;
- that all risks will be detected;
- that all safety boundaries will trigger or hold consistently;
- that all outputs will be appropriate for your situation;
- that reminders or follow-ups will always work; or
- that access will remain available.
Health outcomes depend on many factors outside our control, including genetics, baseline health, diagnosis, medications, adherence, clinician decisions, environment, stress, sleep, food access, training execution, and chance.
20. Risk Acknowledgment
You acknowledge that health and fitness decisions carry risk.
Physical training may cause soreness, pain, injury, aggravation of pre-existing conditions, cardiovascular stress, or other adverse outcomes.
Nutrition changes may affect digestion, energy, blood glucose, medication response, allergies, eating behavior, or medical conditions.
Supplement use may cause side effects, contamination risk, dosing problems, or interactions with medications and conditions.
Wearable data, lab values, screenshots, and self-reported symptoms may be inaccurate, incomplete, outdated, noisy, or misunderstood.
AI may fail to identify the risk, may misunderstand the risk, may fail to enforce a safety boundary, or may produce an answer outside its intended scope.
You voluntarily assume the risks of using either Product and of acting on information you receive, except where liability cannot be excluded by law.
21. Disclaimers
To the fullest extent permitted by law, the Products are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
22. Limitation of Liability
To the fullest extent permitted by law, the FreeGym Parties will not be liable for:
- injuries, illness, adverse health outcomes, or medical complications arising from your use of either Product or reliance on outputs;
- failure to seek medical care or emergency care;
- medication, supplement, training, nutrition, pregnancy, or treatment decisions made without qualified professional review;
- indirect, incidental, consequential, special, exemplary, or punitive damages;
- loss of profits, revenue, goodwill, data, or business opportunity;
- service interruption, delay, error, or data loss;
- third-party services; or
- unauthorized access outside our reasonable control.
To the fullest extent permitted by law, the total liability of the FreeGym Parties for all claims arising from or relating to the Products will not exceed the greater of:
- the amount you paid us for the Products in the three months before the event giving rise to the claim; or
- INR 10,000.
These limits apply regardless of the legal theory, even if we were advised that damages were possible.
23. Indemnification
You agree to indemnify, defend, and hold harmless the FreeGym Parties from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from:
- your use or misuse of the Products;
- your violation of these Terms;
- your violation of law or another person's rights;
- User Content you submit;
- information you submit about another person without authority;
- your reliance on either Product without appropriate professional review;
- your failure to provide accurate information or update material health changes;
- your failure to seek medical or emergency care;
- your public sharing of private or third-party information; or
- disputes between you and another person relating to your use of either Product.
This obligation survives termination of these Terms.
24. Suspension and Termination
You may stop using either Product at any time. You may request account deletion according to the Privacy Policy.
We may suspend, limit, or terminate access immediately if:
- you violate these Terms;
- your use creates safety, legal, privacy, security, operational, or reputational risk;
- you provide false or misleading information;
- you misuse health or third-party data;
- payment fails for a paid service;
- we are required by law;
- early-access capacity changes; or
- we discontinue or materially change the Products.
After termination:
- your right to use the Products ends;
- we may retain information as described in the Privacy Policy;
- outstanding payment obligations remain due;
- provisions that by their nature should survive will survive, including intellectual property, disclaimers, liability limits, indemnity, dispute terms, and privacy-related provisions.
25. Changes to the Products or These Terms
Eureka and Eureka Engine will change as the Products develop. We may add, remove, pause, modify, or discontinue features at any time.
We may update these Terms from time to time. When changes are material, we will update the "Last Updated" date and provide additional notice where required.
Your continued use after updated Terms become effective means you accept the updated Terms, to the extent permitted by law. If you do not agree, stop using the Products.
26. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules.
Before bringing a formal claim, you agree to email support@freegym.club with a description of the dispute and allow 30 days for informal resolution.
Subject to applicable consumer protection laws, courts in New Delhi, India will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Products.
If you access the Products from outside India, local laws may give you mandatory consumer, privacy, health-information, or data protection rights. You are responsible for using the Products only where lawful, and nothing in these Terms limits rights that cannot be waived under the laws of your place of residence.
Where permitted by law, disputes must be resolved on an individual basis. You waive participation in class actions, representative actions, and consolidated proceedings to the extent legally permitted.
27. General Terms
Entire Agreement. These Terms, the Privacy Policy, and any applicable purchase terms are the entire agreement between you and us for the Products.
Severability. If any provision is invalid or unenforceable, the remaining provisions remain effective.
No Waiver. Our failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, restructuring, asset transfer, or change in operations.
Force Majeure. We are not responsible for delay or failure caused by events outside our reasonable control, including outages, provider failures, cyber incidents, natural disasters, labor issues, war, government action, or internet disruption.
Language. The English version controls if a translation conflicts with it.

29. Acknowledgment
By using either Product, you confirm that:
- you have read and agree to these Terms;
- you have read and agree to the Privacy Policy;
- you understand the Products are AI coaching and information organization tools, not a doctor or emergency service;
- you understand AI is non-deterministic and the Products can be wrong, inconsistent, incomplete, or outside scope;
- you understand the Products are tools to support your thinking and reduce friction, not something to rely on blindly;
- you will consult qualified professionals for medical and high-risk decisions;
- you will not delay urgent care because of either Product;
- you are responsible for the information you submit;
- you have authority to submit information about other people; and
- you accept the risks and limitations described above.
